Privacy Policy

Flare Inc. (hereinafter referred to as the "Company") establishes the following Privacy Policy (hereinafter the "Policy") regarding the handling of users' personal information in connection with the services provided on this website (hereinafter the "Services").

Article 1 (Personal Information)

"Personal information" means "personal information" as defined in the Act on the Protection of Personal Information. It refers to information about a living individual that can identify a specific individual by name, date of birth, address, telephone number, contact details, or other descriptions contained in such information, as well as data relating to appearance, fingerprints, or voiceprints, and information that can identify a specific individual on its own, such as the insurer number on a health insurance card (personal identification information).

The Company may also collect transaction records and payment-related information containing a user's personal information generated between the user and business partners from the Company's business partners (including sources of information, advertisers, and advertising distributors; hereinafter "Partners") and other parties.

Article 3 (Purposes of Collecting and Using Personal Information)

The purposes for which the Company collects and uses personal information are as follows:

  1. To provide and operate the Company's Services
  2. To respond to inquiries from users (including verifying the identity of the individual)
  3. To send emails informing users of new features, updates, and campaigns for the Services they are using, as well as other services offered by the Company
  4. To contact users as necessary regarding maintenance, important notices, and similar matters
  5. To identify users who violate the Terms of Use or who attempt to use the Services for fraudulent or improper purposes, and to refuse their use of the Services

Article 4 (Changes to Purposes of Use)

  1. The Company may change the purposes of use of personal information only where it is reasonably recognized that the revised purpose is related to the purpose prior to the change.
  2. If the Company changes the purposes of use, it will notify users of the revised purpose by a method prescribed by the Company or announce it on this website.

Article 5 (Provision of Personal Information to Third Parties)

1. Except in the following cases, the Company will not provide personal information to third parties without obtaining the prior consent of the user. This does not apply, however, to cases permitted under the Act on the Protection of Personal Information or other laws and regulations.

  1. Where it is necessary for the protection of a person's life, body, or property, and it is difficult to obtain the consent of the individual
  2. Where it is particularly necessary for improving public health or promoting the sound development of children, and it is difficult to obtain the consent of the individual
  3. Where it is necessary to cooperate with a national government agency, a local government, or a party entrusted by either in carrying out affairs prescribed by laws and regulations, and obtaining the consent of the individual is likely to impede the performance of such affairs
  4. Where the Company has notified or announced the following matters in advance and has filed a notification with the Personal Information Protection Commission:
    1. That the purposes of use include provision to third parties
    2. The items of data provided to third parties
    3. The means or method of provision to third parties
    4. That provision of personal information to third parties will be discontinued at the request of the individual
    5. The method for accepting requests from the individual

2. Notwithstanding the preceding paragraph, in the following cases the recipient of the information shall not be deemed a third party:

  1. Where the Company entrusts all or part of the handling of personal information within the scope necessary to achieve the purposes of use
  2. Where personal information is provided in connection with the succession of a business due to a merger or other reason
  3. Where personal information is used jointly with a specific party, and the individual has been notified in advance, or the information has been placed in a state where the individual can readily learn of, the fact of such joint use, the items of personal information used jointly, the scope of the parties using it jointly, the purposes of use by such parties, and the name of the party responsible for the management of the personal information

Article 6 (Disclosure of Personal Information)

1. When requested by an individual to disclose their personal information, the Company will disclose it to the individual without delay. However, if disclosure falls under any of the following, the Company may not disclose all or part of the information, and if it decides not to disclose, it will notify the individual to that effect without delay. A fee of 1,000 yen per request will be charged for the disclosure of personal information.

  1. Where there is a risk of harming the life, body, property, or other rights and interests of the individual or a third party
  2. Where there is a risk of significantly impeding the proper conduct of the Company's business
  3. Where disclosure would otherwise violate laws and regulations

2. Notwithstanding the preceding paragraph, the Company will, as a general rule, not disclose information other than personal information, such as history information and characteristic information.

Article 7 (Correction and Deletion of Personal Information)

  1. Where a user's own personal information held by the Company is inaccurate, the user may request the Company to correct, add to, or delete such personal information (hereinafter "Correction, etc.") in accordance with the procedures prescribed by the Company.
  2. If the Company receives a request under the preceding paragraph from a user and determines that it is necessary to respond to the request, it will carry out the Correction, etc. of the relevant personal information without delay.
  3. If the Company makes a Correction, etc. pursuant to the preceding paragraph, or decides not to make a Correction, etc., it will notify the user thereof without delay.

Article 8 (Suspension of Use of Personal Information)

  1. Where the Company is requested by an individual to suspend or erase the use of their personal information (hereinafter "Suspension of Use, etc.") on the grounds that the personal information is being handled beyond the scope of the purposes of use or was obtained by improper means, the Company will conduct the necessary investigation without delay.
  2. If, based on the results of the investigation in the preceding paragraph, the Company determines that it is necessary to respond to the request, it will carry out the Suspension of Use, etc. of the relevant personal information without delay.
  3. If the Company carries out a Suspension of Use, etc. pursuant to the preceding paragraph, or decides not to carry out a Suspension of Use, etc., it will notify the user thereof without delay.
  4. Notwithstanding the preceding two paragraphs, where a Suspension of Use, etc. would require substantial expense or would otherwise be difficult to carry out, and where alternative measures necessary to protect the rights and interests of the user can be taken, the Company will implement such alternative measures.

Article 9 (Changes to the Privacy Policy)

  1. The contents of this Policy may be changed without notice to users, except for matters otherwise provided by laws and regulations or by this Policy.
  2. Unless otherwise specified by the Company, the revised Privacy Policy shall take effect from the time it is posted on this website.
